Delivery disclaimer.
Container delivery is heavy equipment work. This page explains the space we need, what you are responsible for, and what we are and are not responsible for. Please read it before scheduling.
Container delivery is heavy equipment work. A loaded truck and a steel container place substantial weight and stress on the ground they travel over and rest on, and the space required to maneuver is larger than most people expect.
This page explains what we need from your site, what you are responsible for, and what we are and are not responsible for. Please read it before scheduling delivery.
This disclaimer is incorporated into our Terms of Use. Where you have signed a separate rental, purchase, or delivery agreement with Max Mobile Storage, that signed agreement controls if anything here conflicts with it.
Space you must have available
Our delivery trucks place containers by sliding them off a tilting bed and driving forward out from underneath. This requires a straight, unobstructed run of level ground.
For a 20-foot container, we need 65 feet of room to set the container down and pull out from underneath it. For a 40-foot container, we need 120 feet of room.
This is the space required at the placement point itself, measured in a straight line, in addition to the space needed to get the truck to that point. It is not a suggestion. If the space is not there, the container cannot be placed by truck. You must also provide:
- Adequate overhead clearance along the entire approach and at the placement point, free of power lines, telephone and cable lines, tree limbs, roof overhangs, awnings, carports, gates, arches, and signage
- Adequate width clearance for a commercial truck and trailer along the entire route from the public road to the placement point
- Turning radius sufficient for a commercial vehicle at every turn, including the entrance from the street
If you are unsure whether your site works, call us before scheduling at (541) 200-3830. We would rather talk it through in advance than send a truck that cannot complete the job. In tight locations we can sometimes bring a skid steer or forklift to set the container in place. Tell us in advance so we can plan for it, as this may affect scheduling and cost.
Ground and site condition requirements
The delivery area and the entire route to it must be:
- Level. Sloped, crowned, or uneven ground causes containers to sit unevenly, doors to bind or fail to seal, and containers to shift or settle over time.
- Hard packed. The surface must support the weight of a fully loaded commercial truck. Soft soil, mud, sand, loose gravel, fresh fill, saturated ground, snow, ice, and recently landscaped areas are not suitable.
- Clear. Free of vehicles, trailers, equipment, materials, debris, low fencing, planters, landscaping features, and anything else obstructing the route or the placement point.
You are responsible for preparing the site before we arrive. If site conditions prevent safe delivery when our driver arrives, the delivery will not be completed.
Your responsibilities before delivery
Before your scheduled delivery, you must:
- Confirm you have the right to place a container at the location. If you rent, lease, or do not solely own the property, obtain the property owner’s or landlord’s written permission.
- Obtain any required permits and approvals. Container placement may require permits or approvals from your city, county, homeowners association, architectural review committee, or fire district. Requirements vary by jurisdiction and by whether the placement is temporary or permanent. Determining and obtaining these is your responsibility, not ours. We do not verify zoning compliance, setback requirements, or permit status.
- Locate and mark everything underground, including septic tanks, drain fields and leach lines, water, sewer, gas, electrical and fiber lines, irrigation and sprinkler systems and their control valves, well heads, cisterns and pump housings, French drains, culverts and drainage structures, buried propane tanks, and any other underground structure, utility, or void. Call 811 or your local utility locate service if you are uncertain. We cannot see what is beneath the surface and we rely entirely on your markings.
- Identify overhead hazards along the entire route and at the placement point.
- Clear the route and placement area of vehicles, equipment, and obstructions.
- Arrange for someone 18 or older to be present, or provide written authorization for unattended placement along with clear placement instructions and site markings. If placement is unattended, we will place the container according to your instructions using our best judgment, and you accept the resulting placement.
- Confirm the exact placement point and door orientation with us in advance. Once a container is set, repositioning requires a return trip and may incur additional charges.
Property damage, please read carefully
Delivering a container to your property carries an inherent risk of damage to that property, and by scheduling delivery you accept that risk.
Our trucks are heavy. Even with careful, experienced drivers, the weight, ground pressure, and turning of a commercial delivery vehicle can cause:
- Cracking, spalling, depressions, tire marks, or gouging in concrete driveways, aprons, walkways, and slabs
- Rutting, cracking, softening, scarring, or depression of asphalt
- Ruts, compaction, tearing, and killing of lawns, turf, and ground cover
- Damage to gravel and paver driveways, including displacement and settling
- Damage to curbs, sidewalks, gutters, and drainage structures
- Damage to landscaping, plantings, trees, tree roots, and irrigation components
- Damage to septic systems, drain fields, and underground utilities
- Damage to gates, fencing, mailboxes, and low-hanging structures
To the fullest extent permitted by law, Max Mobile Storage is not responsible for damage to driveways, walkways, aprons, curbs, lawns, landscaping, irrigation, septic systems, underground utilities, or other property caused by the ordinary weight, movement, or operation of delivery vehicles and equipment on your property or on the approach to it.
This includes damage occurring on shared driveways, private roads, easements, and public rights-of-way used to reach your site.
You are responsible for damage to underground structures that were not accurately marked, including septic systems, drain fields, irrigation lines, and utilities, and for damage to our equipment resulting from unmarked underground hazards or unsafe site conditions.
If you are concerned about your driveway or surface, tell us in advance. We can discuss the use of plywood, mats, or an alternate placement point. Any protective materials are your responsibility to supply unless we agree otherwise in writing.
None of the above limits liability for damage caused by our gross negligence or willful misconduct, and nothing on this page waives any right you have that cannot be waived under applicable law.
Driver discretion and refused deliveries
Our driver has final authority on whether a delivery can be completed safely. Our driver may decline to complete a delivery, or may place the container at the nearest safe alternate location, if in their judgment:
- Site conditions are unsafe, unstable, or unsuitable
- Clearance is insufficient
- Weather, road, or ground conditions create risk
- The route or placement point risks significant property damage
- Underground hazards are unmarked or uncertain
- Anyone’s safety would be at risk
A driver’s decision to attempt a difficult delivery at your request does not transfer responsibility for the outcome to us.
Failed deliveries, redelivery, and wait time
If our driver arrives and the delivery cannot be completed because the site was not ready, access was blocked, permission or permits were not in place, no authorized person was available, or conditions were unsafe:
- The delivery will be treated as a failed delivery
- A redelivery trip must be scheduled
- Additional charges apply, including redelivery, trip, and wait-time fees at our then-current rates
Current fee amounts are provided in your quote or agreement, or by calling (541) 200-3830. Fees are not published on this Site because they vary by distance and equipment.
Scheduling and delivery windows
We recommend booking at least one week in advance. We will do our best to accommodate urgent requests, but short-notice availability is not guaranteed and may be limited by equipment and driver availability.
Delivery dates and time windows are estimates, not guarantees. Deliveries may be delayed or rescheduled due to weather, road conditions, traffic, equipment failure, driver availability, permitting delays, prior jobs running long, or circumstances beyond our control.
We are not liable for any loss, cost, or damage arising from a delayed, rescheduled, or missed delivery window, including moving crew costs, truck rental costs, labor costs, lost wages, lodging, storage costs, or missed deadlines.
If you are coordinating a move around the delivery, build in buffer time. If we need to reschedule, we will contact you at the phone number or email you provided as soon as we know.
Weather and seasonal conditions
Snow, ice, sustained rain, flooding, high wind, wildfire activity, road closures, and extreme heat may delay or prevent delivery, relocation, and pickup. Saturated or frozen ground may make an otherwise suitable site temporarily unusable. We will reschedule as soon as conditions allow.
Placement, settling, and shifting
Once a container is placed, ground conditions change with weather, moisture, freeze-thaw cycles, and load. Containers can settle, shift, or become unlevel over time.
Monitoring the container’s condition and the ground beneath it is your responsibility while it is on your property. A container that becomes unlevel may develop doors that bind, fail to latch, or fail to seal against water.
Do not stack, climb on, modify, cut into, weld, drill, or attach structures to a rented container without our prior written approval. Do not place a rented container on blocks, piers, footings, or a foundation without our prior written approval.
If you believe a container has shifted, become unstable, or is unsafe, stop using it and contact us immediately at (541) 200-3830.
Contents, loading, and insurance
Max Mobile Storage does not insure the contents of any container. Insuring what you store is your responsibility. Check whether your homeowner’s, renter’s, or commercial policy covers property stored in a portable container, and obtain separate coverage if it does not. You are solely responsible for:
- What you place in the container
- How you load, distribute, secure, and brace the contents
- Weight distribution and not exceeding the container’s capacity
- Locking and securing the container
- Any loss or damage to contents from shifting during transport, moisture, condensation, temperature, pests, theft, vandalism, fire, or weather
Containers are weather-resistant. They are not climate controlled, watertight under all conditions, or airtight. Condensation can form inside a steel container. Do not store anything that will be ruined by moisture, humidity, or temperature swings without appropriate protective packing.
Where you retain the key and control access to a container on your own property, we do not take custody or possession of your property, and no bailment is created.
Prohibited contents
Do not place any of the following in a Max Mobile Storage container:
- Hazardous, toxic, corrosive, radioactive, or biohazardous materials
- Flammable or combustible liquids, gases, fuels, propane tanks, or pressurized cylinders
- Explosives, fireworks, ammunition in bulk, or weapons prohibited by law
- Illegal drugs, controlled substances, or any illegal item
- Stolen property
- Perishable food, produce, or anything that attracts pests or generates odor
- Living things, including people, pets, livestock, and plants
- Anything prohibited by federal, state, or local law
You are responsible for all costs of cleanup, remediation, disposal, fines, and damages arising from prohibited contents, and we may refuse to transport, relocate, or accept return of a container containing them.
Relocation and pickup
The requirements on this page apply equally to container relocation and pickup. For us to remove or move a container, it must be:
- Fully accessible with the clearances stated above
- Closed and secured, with any customer locks removed unless arranged otherwise
- Free of any obstruction, structure, deck, fence, landscaping, or vehicle placed around it after delivery
- Sitting on ground firm enough to support the truck
Do not build around, attach to, or landscape over a rented container in any way that will prevent removal. If a container cannot be retrieved because of changes to the site after delivery, you are responsible for the cost of making it accessible and for any additional trip charges.
Custom Work and modified containers
Custom work turnaround times vary by job and are estimates only. Modified containers may weigh more, have altered structural characteristics, and require different handling or placement conditions than standard containers. Discuss placement requirements with us before scheduling delivery of a modified unit.
